Before bringing any such action, you must provide InterNACHI with 30 days’ written notice of the nature of the claim, in sufficient detail and with sufficient supporting documents that InterNACHI can evaluate it. In any action against us or InterNACHI, you waive trial by jury. Additionally, when confronting allegations, claims professionals often use signed pre-inspection agreements as the home inspector’s first line of defense. They do so by emphasizing the limitations of liability and inspection scope outlined therein. Frequently, claims adjusters can dismiss frivolous allegations against a home inspector with the help of the inspector’s pre-inspection contract—much like the California court dismissed Moreno v. Sanchez.

Some regulated states require inspectors to obtain signed contracts. Check the laws affecting your state and region to confirm. Note that many home inspection insurance policies do not provide coverage for free inspection services.
We will perform a visual inspection of the home/building and provide you with a written report identifying the defects that we observed and deemed material. The report is only supplementary to the seller’s disclosure. Inspecting without an agreement, or having clients sign your contract after you begin the inspection, isn’t worth the cost.

The Client further agrees that the Inspector is liable only up to the cost of the inspection. D. The Client agrees that, to the extent allowed by law, any damages or breach of this contract or report are limited to the amount of the inspection fee only. Minor and cosmetic defects may be listed in the report for maintenance purposes, but it is not the intent, nor will the inspection report identify and list all minor and cosmetic defects. The insurance company that issued Acorn's Errors and Omissions Insurance Policy requires this agreement to be signed before any inspection is done. The inspection is intended to evaluate systems and components of the primary premises. Evaluation of primary attached garages/carports/decks/porches/patios, are also included. Detached garages/carports/patios/decks or other structures unless explicitly specified, are not included.

Without signatures signifying consent and agreement, it’s just your word against your clients’. But it’s more than just a matter of who signs the dotted line (a topic we’ll explore in more detail in the Managing Risk column in the November issue of the ASHI Reporter). If a court declares any provision of this Agreement invalid, the remaining provisions remain in effect. This Agreement represents our entire agreement; there are no terms other than those set forth herein. All prior discussions are merged into this Agreement.
Unless otherwise indicated in writing, we will not test for compliance with applicable building codes or for the presence of or for any potential dangers arising from the presence of asbestos, lead paint, soil contamination, or other environmental hazards or violations. If any structure you want us to inspect is a log structure or includes log construction, you understand that such structures have unique characteristics that may make it impossible for us to inspect and evaluate them. Therefore, the scope of our inspection will not include decay of the interior of logs in log walls, log foundations or roofs, or similar defects. When you have an idea of what items you need to include on your pre-inspection agreement, get a legal professional to look it over.
